The anti-SLAPP statute is very counter-intuitive and its remedies can be surprisingly potent – which can be a very good thing or a very bad thing, depending on which side of the anti-SLAPP motion you find yourself. Therefore, it is vital to be able to recognize and either capitalize on or minimize or avoid anti-SLAPP issues (which can come up in all manner of cases, including personal-injury, business litigation, employment litigation and even probate litigation). For example, imagine having to explain to your client why he or she has to pay the other side’s steep attorney fees in connection with the motion because you never saw or heard of such a motion before.
