SBRA of 2019: The New Small Business Bankruptcy Law, a Creditor Game-Changer

The new small business bankruptcy law (Small Business Reorganization Act of 2019) took effect on February 19, 2020.  The law aims at increasing the accessibility of bankruptcy relief for small businesses.  It appears the law will reduce cost and paperwork associated with small business bankruptcies.  One of the most eye-catching provisions of the new law is allowance for non-consensual bankruptcy plans.  Yet, some of the law’s likely practical effects are probably unanticipated.

The presentation will focus on distilling practical issues with application of the new law, from both the creditor and debtor perspectives.  Although information will be included on how the new law changes existing bankruptcy law, the presentation’s goal will be to assist professionals unaccustomed to business bankruptcy encounters.  A large portion of the time will be devoted to questions.
