• Do a litmus test of the expert’s experience, i.e., helped in discovery, facilitated in the examination of opponent’s expert, prepared clear report with logical assumption, response style to hostile questions by opposing counsel, et al.
• Don’t agree to a vague engagement agreement get the details clearly established.
