Consumer Bankruptcy in a Perfect Storm (for non-bankruptcy practitioners)

Like mushrooms after a rainy day, bankruptcy issues are popping up everywhere in the consumer realm. If you are a consumer practitioner in non-bankruptcy disciplines such as estate planning, probate, family law, personal injury, etc., you may be starting to think seriously about whether and how to tackle insolvency and bankruptcy issues your clients are facing. This webinar is designed to guide you through the dos and don’ts of how to approach bankruptcy issues: when a bankruptcy case may be appropriate, who should file it (you or a bankruptcy practitioner), to whom you should be referring a potential bankruptcy filing, and how you can start a consumer bankruptcy practice yourself. Approaching every bankruptcy issue must always involve the perspective of the bankruptcy court system, the bankruptcy trustees in charge of administering consumer cases, and the United States Trustee who stands watch over misconduct by both attorneys and lay persons in bankruptcy. Avoiding sanctions and malpractice are overarching themes. Emphasis will be given on how bankruptcy courts view non-bankruptcy practitioners and on what you may expect from adjudications by bankruptcy judges. The webinar aims at providing a balanced view to non-bankruptcy attorneys of the players and pitfalls of bankruptcy practice, helping such attorneys decide whether and to what extent to tackle bankruptcy issues.
