AI and Fabricated Evidence

Hosted by San Diego County Law Library

Cost: Free

About the Program: We have all now heard of AI and many are using it, some for nefarious purposes in litigation. The ready accessibility of AI tools to fabricate digital evidence in litigation has led to a need to evaluate evidence with a critical eye. Don Vilfer and Divya Dwarakanath of Digital Evidence Ventures will cover the tech and law related to digital evidence authentication and share eye-opening examples from real cases where their firm has been called in to evaluate and testify about such. This will be a great opportunity to get the knowledge you should have to stay ahead of the curve in this new area.

About the Speakers: Don is the founder of Digital Evidence Ventures, a top-tier Computer Forensics firm with offices in California and Idaho. Don is a sought-after expert and has provided sworn testimony in over 130 cases. He served in the FBI as a Special Agent, including working dozens of high-profile cases while leading an FBI Headquarters Major Case Management Team at venues from The White House to the Oklahoma City Bombing. His last FBI assignment was as the Supervisory Special Agent in charge of White-Collar Crime and Computer Crime in Sacramento. Don is a member of the Ohio Bar (inactive). He is also a frequent commentator for the media and was a lecturer in the University of California, Davis Master’s in Forensic Science program.

Divya began her career as a penetration tester, also known as an ethical hacker, working with leading technology companies across the Bay Area, including organizations such as Google, Apple, Meta, Square, Amazon, and numerous high-growth startups. In that role, she helped identify and remediate critical security vulnerabilities across a wide range of products and services.  She then spent nearly a decade at Snapchat, where she served as a Senior Manager leading corporate security, incident investigations, and red teaming efforts, simulating real-world attacker behavior to strengthen organizational defenses.  Today, as CTO and Senior Forensic Examiner at Digital Evidence Ventures, Divya is a certified forensic expert specializing in mobile, cloud, windows and social media forensics. She works closely with legal teams to uncover, analyze, and explain digital evidence in complex matters.
