Although a criminal record can never be completely eliminated, the consequences of criminal convictions as it may pertain to occupational or professional licensing or immigration may be reduced by postconviction petitions that include early termination of probation, reducing certain felonies to misdemeanors, and/or vacating convictions. This class will focus on particular Penal Code sections that provide some relief.
Sections to be covered:
Penal Code section 17: Post-conviction reduction of a felony to a misdemeanor
Penal Code section 1203.3: Early termination of probation
Penal Code section 1203.4: Dismissal of felony or misdemeanor conviction after probation
Penal Code section 1203.41: Dismissal of felony conviction after completion of a county jail felony sentence
Penal Code section 1170.18; 667(e)(2)(C)(iv): Recall, resentence and redesignation of on certain felony convictions for drug possession, shoplifting, petty theft, insufficient funds and forgeries that were made misdemeanors pursuant to Proposition 47 (2014).
Proposition 64 (2016): Reduced particular felony cannabis offenses to misdemeanors, or misdemeanor cannabis offenses to infractions, or repealed them entirely.
