Law Firms and Other Business Associates Under HIPAA: Will They Pass an Audit?

The HHS Office for Civil Rights (OCR) has begun its next phase of audits of covered entities and their business associates. Law firms representing covered entities are fair game for these audits – they are Business Associates under HIPAA. Some law firms believe they need not fully comply with HIPAA because of the litigation exception. These firms are mistaken. Marcia Augsburger, a partner at King & Spalding, will explain why and what to do to proactively avoid problems if OCR or a client seeks an audit. She will also provide information to covered entities who may wish to audit their Business Associates about what to look for and how to prepare for their own OCR audits.

In addition, Ms. Augsburger will address “Are state, county or local health departments required to comply with the HIPAA Privacy Rule?”
