How to Avoid Failure at Mediation

We live in an adversarial time, at once valuing our right to state our views, and to reject the other side’s position entirely. Counsel’s obligation to zealously represent the client’s interests often fails to generate successful settlement discussions. Accepting the adversary as an equal and necessary party to negotiation is required for success. This class will discuss how to foster and develop settlement discussions both before and during mediation.
